I activated and configured the taxonomy_entity_index module and it hid the taxonomy entries without related nodes.
I added a new node in an empty term, but the menu item remained hidden.

The patch fails using the latest dev version.
In my opinion, looking at the code, we should perform a check to verify the existence of the frontpage view, as it doesn't exist in the minimal Drupal installation.
