with that said, I no longer see the widget icon for embed_block in the ckeditor5 , the above patch fixes an error message but doesn't solve ckeditor5 compatibility completely

The CKEditor 4 button EmbedBlock does not have a known upgrade path. If it allowed editing markup, then you can do so now through the Source Editing functionality.

@joseph.olstad my assumption is that you are testing this at the same time as ✨ Embed Block CKEditor Enhancement Needs work ?
I have tested the patch and it works. It does not offer a widget or button, but neither does the current module - this is just a required fix for the filter format to allow the
{block:*}syntax to be used in CK Editor 5.
