The issue in #2 refers to all attributes, therefore I am closing this as a duplicate of that one.
Password confirm field does not inherit attributes #attributes and #error_no_message.

The password confirm field is very stubborn when it comes to defining its attributes in a custom form.
Account for the $element attributes with default values.
