Tested on Drupal 10.1 and Country path 8.x-1.6, the patch works great ! I had the same issue and with the patch the issue is fixed.
When setting up a site the home page displays in the default language when a path-based language is specified
Set up a site with a default language (example: en). Add at least one additional language (example: es). Create a node and set the home page to the created node. Translate the node to the secondary language. Navigate to example.com, verify the site is in english. Navigate to example.com/es, the site will remain in english.
