AJAX counter is not triggered using panels

I have a project where are many custom view modes and some more custom stuff. So this does not pass the condition:

if (!empty($node->nid) && $view_mode == 'full' && node_is_page($node) && empty($node->in_preview)) {

on settings.php line 120
I have created a simple patch for that.
