The config library.notice_as_modal is no longer used but it's still contained in the default klaro.settings.yml file. As a result, Drupal CMS tests are failing, see https://git.drupalcode.org/issue/drupal_cms-3487164/-/jobs/3351196
Remove that setting from the file.
