Steps to reproduce were never provided — the sample code in #3 is inadequate to reproduce this.
That being said, I bet this was actually just another symptom of the long-standing core bug #1988968: Drupal.ajax does not guarantee that "add new JS file to page" commands have finished before calling said JS → which was finally fixed in
9.5.0!If you can still reproduce this, please reopen this and provide actual steps to reproduce this on a fresh Drupal site. 🙏
