validate does not respect form alter

When you have field configured to use require on publish and then you hide field via form alter for example via #access=FALSE this field is still considered as empty and throw an error on the hidden (for user) field.

    I'm having a similar issue - not using hook form alter but using multiple form modes on a content type. When you are using a version of the form, which does not have the fields which are marked as 'ROP', I would not expect the validation to run on those fields, but it is. Any ideas how to avoid this?
