Drupal 7 currently requires PHP 5.2.4 or greater. I am aware of no supported OS version that packages PHP 5.2*. So PHP <5.3 code in Browscap, which I currently have no way to test, seems like it could be removed.
It is possible someone could reasonably be using an unsupported PHP 5.2 version on an isolated network, but the PHP <5.3 code in this module is only executed after making an Internet connection. So there seem to be no secure circumstances where the PHP <5.3 code would be executed.
*RHEL 5 still supports PHP 5.1 with backported fixes, but 5.1 does not meet Drupal 7 requirements.
