Looks like the logic introduced in dialog.position.js, which came a little while after this issue was filed, addresses this as it prevents the dialog from being rendered in the same space as the toolbar.
The following image shows a long dialog, long enough to need a scrollbar. The top of the dialog is positioned behind the Toolbar.
