It has been about 7 months and there has not been confirmation that this is still a problem in a supported version of core. Therefore I am closing this as outdated.
When using EntityFieldQuery::pager and node_acces is enabled (by using the simple_access-module in my case) theme('pager'); would not render the pager. The bug seemed to be the same that views had in #1046170
The applied patch was written by dereine who helped me in IRC and asked me to submit this.
