I presume in this case that site is running Drupal 9.0. Since these issues wouldn't be visible in 8.9. or 9.1. While 9.0 is not supported anymore and we strongly recommend upgrading to at least 9.5, we recognize this is a bug and will fix shortly!

Double checked https://git.drupalcode.org/project/drupal/-/blob/9.1.x/core/lib/Drupal/C... and https://git.drupalcode.org/project/drupal/-/blob/9.0.x/core/lib/Drupal/C... the change was on 9.1.x, so the version compare change is correct

Fixed! I also made a small change to one of our tests that used a similar check for Drupal 9.5. Since there is a method that works since Drupal 8.8, I made that change as well.
Automatically closed - issue fixed for 2 weeks with no activity.
