Disabled logic is not working as expected

In a snippet like this

  <figcaption>
    <span>TERM</span>
    <span>&copy; TERM</span>
  </figcaption>
</figure>

With `figcaption` and `figure` in disabled tags, still the second occurrence of TERM is highlighted

I tested this on a clean install using Drupal 9.5.4 and couldn't recreate the issue. When adding your HTML code and set the configuration as described, neither occurrence of "TERM" is served with a tool tip.
