In panopoly_test.behat.inc we have the configurePrivateFiles() method, which is supposed to set the 'file_private_path' variable if it isn't set (but only for the duration of that Behat scenario).
Right now, it appears to be doing the opposite: it's only setting the 'file_private_path' if it's already set!
