Notification not sent when transition created programmatically

I had the same problem, the previous patch solved.
But didn't react on newly created nodes, even with this #3120004: Create Notification with create state → .

So make it work, I had to keep the validation of empty because of the newly created node.

Missing line. Now is corrected.
