If you have a product with at least 2 variations, one of them out of stock, you are able though to switch from an in-stock variation to an out-of-stock, but choosing another variation from an out of stock variation breaks the add to cart form Ajax entirely.
A quick debugging showed me that the embedded notification form is causing the troubles. The obvious solution would be to replace the traditional form implementation with a CommerceInlineForm plugin implementation. Because that's why have that inline forms in Commerce
