Return 404 with custom search page

I searched the queue and was unable to parse the solution for this.
There has been a lot of talk about this.... Perhaps it's in .dev

Am I missing something?

Using Do a "Search" with custom path instead of a Drupal Search when a 404 occurs

The issue is the header of the incorrect URL returns the following:

Request URL:http://drupalauth.local/pei
Status Code:301 Moved Permanently
TO
Request URL:http://drupalauth.local/en/pei
Status Code:302 Found
TO
Request URL:http://drupalauth.local/en/search/site/pei
Status Code:200 OK

Shouldn't the first be a a 404?

Also the current behavior makes it difficult to find bad URL's on the site because they ALL return 302 found.
